The bottom line is that the current filing by Cox (RatesYoYoing) again offers an opportunity for the City to use its regulatory status as franchising authority to request an audit and review of Cox's billing practices. FCC rules allow the City to file for an rate audit as was done in 2002. You will recall that Cox reneged on their 2002 offer to provide their records for the earlier audit, with the excuse that the City had not met the time limitations for requesting the records. However, the data obtained in a 2004 audit should be extremely useful in all franchise negotiations and future Task Force actions.
